By completing a booking or participating in any activity, you confirm that you have read, understood, and agreed to this Liability Disclaimer. If you are booking on behalf of others, you confirm that all participants have been made aware of and accept these terms.

2. Services Covered

This disclaimer applies to all services offered through the platform, including but not limited to guided hikes, nature walks, sightseeing tours, driving tours, private transfers, equipment sales, equipment rentals, and any related add-ons or enhancements.

3. Remote Island Conditions

Seychelles is a remote island destination with limited infrastructure in many areas. Emergency response, medical facilities, mobile phone coverage, and road conditions may differ significantly from what you are accustomed to in your home country. By participating, you acknowledge and accept these conditions.

4. Assumption of Risk

Participation in outdoor activities involves inherent risks. By booking and participating, you voluntarily assume all risks associated with the activity, including but not limited to:

4.1 Outdoor Activities

  • Uneven, slippery, or unstable terrain
  • Steep ascents and descents
  • Falling rocks, branches, or debris
  • Exposure to heat, sun, rain, humidity, and rapidly changing weather
  • Encounters with wildlife, insects, or plants
  • Fatigue, dehydration, or physical overexertion
  • Limited access to emergency or medical services in remote areas

4.2 Driving and Transfers

  • Road conditions including narrow, unpaved, steep, or winding roads
  • Varying standards of road infrastructure
  • Risks inherent to road travel in tropical island conditions

4.3 Goods (Sales and Rentals)

  • Equipment sold or rented is provided as-is and should be inspected before use
  • Proper use and suitability are the responsibility of the customer

5. Health & Fitness

You are responsible for assessing your own physical fitness and health before booking and participating. If you have any medical conditions, injuries, allergies, or physical limitations that may affect your ability to participate safely, you must inform us before the activity. We reserve the right to exclude participants if we believe participation poses a safety risk.

6. Safety Instructions

Participants must follow all safety instructions provided by the guide or operator at all times. Failure to comply may result in exclusion from the activity without refund. We are not liable for any injury, loss, or damage resulting from a participant's failure to follow instructions.

7. Transfers

Transfers are provided as a convenience and are subject to road and traffic conditions. Passengers must wear seatbelts at all times. We are not liable for delays, changes to routes, or incidents arising from road conditions beyond our control.

8. Personal Property

We are not responsible for any loss, theft, or damage to personal property during any activity or transfer. Participants are advised to leave valuables at their accommodation and to carry only essentials.

9. Photography

Photographs and video may be taken by guides during experiences for operational or promotional purposes. By participating, you consent to the capture and use of such images. If you wish to opt out, please inform the guide before the activity begins.

10. Third-Party Providers

Some services may be arranged through or fulfilled by third-party providers. While we take care in selecting our partners, we are not liable for the acts, omissions, negligence, or defaults of any third-party provider. Third-party providers may have their own terms and conditions.

11. Shop Sales

Products sold through our platform are provided as-is. We do not offer warranties beyond those required by law. Customers are responsible for inspecting goods upon receipt and ensuring suitability for their intended use.

12. Shop Rentals

Rented equipment must be inspected by the customer before use. The customer is responsible for the proper use and timely return of rented items. Loss or damage to rented equipment may result in charges. We are not liable for injury or loss arising from the use of rented equipment.

13. Release of Liability

To the fullest extent permitted by law, you release The Cool Tour Guide (Seychelles), its owners, employees, guides, agents, and partners from any and all claims, damages, losses, costs, and expenses (including legal fees) arising from or related to your participation in any service, except where such liability cannot be excluded by law.

14. Mandatory Legal Carve-Outs

Nothing in this disclaimer is intended to limit or exclude liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be limited or excluded under applicable law

15. Indemnity

You agree to indemnify and hold harmless The Cool Tour Guide (Seychelles) from any claims, demands, or damages (including legal fees) arising from your participation in any activity, your breach of these terms, or any negligent or unlawful conduct on your part.

16. Emergencies

In the event of an emergency, the guide or operator will take reasonable steps to ensure participant safety. However, due to the remote nature of some locations, emergency response times and available resources may be limited. Any costs incurred for emergency evacuation, medical treatment, or related services are the responsibility of the participant.

17. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising from or related to a service shall not exceed the total amount paid by you for that specific service. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

18. Changes & Force Majeure

We reserve the right to modify, reschedule, or cancel any service due to weather, safety, environmental conditions, operational requirements, or events beyond our control (force majeure). In such cases, we will make reasonable efforts to offer an alternative. Refund eligibility is subject to the Cancellation & Refund Policy.

19. Governing Law

This Liability Disclaimer is governed by the laws of the Republic of Seychelles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Seychelles, unless otherwise required by mandatory applicable law.

20. Severability

If any provision of this Liability Disclaimer is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
